1 Parties and Effective Conditions
This User Agreement (hereinafter referred to as "this Agreement") is a legally binding agreement entered into between you (hereinafter referred to as "You") and the operator of Diya (hereinafter referred to as "We") in connection with Your use of the Diya audio-visual social application (hereinafter referred to as "the App").
By downloading, installing, registering, logging in, or using any function of the App, You acknowledge that You have fully read, understood, and agreed to all the terms of this Agreement, including but not limited to this Agreement, the Privacy Policy, the Children's Safety Policy, and the relevant provisions on technical support. If You do not agree to any term of this Agreement, please do not use the App.
This Agreement shall take effect on the date You first use the App and shall remain in effect until You cancel Your account or We terminate the App services.
2 User Eligibility and Account Registration
2.1 You confirm that You are at least 18 years old (if the minimum age for use specified by the laws of the region where You are located is higher than 18 years old, the provisions of that region shall prevail), have full capacity for civil conduct (minors using the App shall be consented to and supervised by their legal guardians), and have the right to sign this Agreement and use the App services.
2.2 You shall complete the registration through the registration channels provided by the App (such as mobile phone number, third-party account association, etc.), provide true, accurate, and complete personal information (including but not limited to mobile phone number, nickname, avatar, etc.), and update the information in a timely manner to ensure its validity. If You provide false information, We have the right to suspend or terminate Your account usage right, and all consequences arising therefrom shall be borne by You.
2.3 You shall be responsible for the security of Your account and password, and shall not lend, rent, or sell Your account or password to any third party. Any loss caused by improper operation on Your part or account leakage shall be borne by You. If You find any unauthorized use of Your account, You shall promptly notify Us and take necessary measures to prevent further losses. We shall not be liable for any loss caused by Your failure to perform Your obligation of care.
3 User Rights and Obligations
3.1 You have the right to use all the basic functions of the App in accordance with this Agreement, including but not limited to audio and video calls, social interaction, and content release, provided that You comply with this Agreement and relevant laws and regulations.
3.2 You shall abide by the following obligations when using the App: (1) Comply with the laws, regulations, and public order and good customs of the country/region where You are located and the country/region where We operate; (2) Do not use the App to engage in any illegal or improper activities, including but not limited to spreading illegal information, infringing on the rights and interests of others, fraud, harassment, or engaging in activities that violate public order and good customs; (3) Do not upload, publish, or disseminate any content that is obscene, pornographic, violent, terrorist, defamatory, slanderous, or infringes on the intellectual property rights or other legitimate rights and interests of others; (4) Do not tamper with, reverse engineer, decompile, or crack the App, or use any plug-ins, cheats, or other tools to interfere with the normal operation of the App; (5) Do not collect, store, or disclose the personal information of other users without their consent; (6) Cooperate with Our reasonable supervision and management of the App and user behavior.
4 Service Provisions
4.1 We shall provide You with App services in accordance with the provisions of this Agreement and the current technical level, and shall make reasonable efforts to ensure the stability and normal operation of the App. However, We do not guarantee that the App will be free from any errors, interruptions, or delays, and shall not be liable for any loss caused by temporary service interruptions due to force majeure, technical failures, or other reasons beyond Our control.
4.2 We have the right to update, upgrade, or adjust the functions of the App from time to time, and will notify You through in-App prompts, announcements, or other reasonable means. If You do not agree to the update, upgrade, or adjustment, You may choose to stop using the App, and We shall not be liable for any loss caused thereby.
4.3 We have the right to suspend or terminate the provision of services to You if You violate this Agreement, relevant laws and regulations, or the rules of the App, or if Your account is involved in illegal or improper activities. We will notify You of such suspension or termination in a reasonable manner, and all consequences arising therefrom shall be borne by You.
5 Intellectual Property Rights
5.1 All intellectual property rights related to the App, including but not limited to copyrights, trademarks, patents, trade secrets, and other proprietary rights, are owned by Us or the relevant right holders authorized by Us. You shall not infringe upon any of the above intellectual property rights in any way.
5.2 The content uploaded, published, or disseminated by You through the App (including but not limited to text, images, audio, video, etc.) shall be owned by You or You have obtained the legal authorization of the relevant right holders. You shall be responsible for the content You upload, publish, or disseminate, and shall not infringe upon the intellectual property rights or other legitimate rights and interests of others. If You cause any loss to Us or a third party due to infringement, You shall bear full compensation liability.
6 Termination of Agreement
6.1 This Agreement may be terminated in the following circumstances: (1) You voluntarily cancel Your account and complete the cancellation procedures in accordance with the App rules; (2) We terminate the provision of App services in accordance with relevant laws and regulations or this Agreement; (3) You violate this Agreement and We terminate the Agreement in accordance with the provisions hereof; (4) The App is terminated due to force majeure, legal changes, or other reasons beyond Our control.
6.2 After the termination of this Agreement, You shall stop using the App and all related services. We shall have the right to retain or delete Your account information and user data in accordance with relevant laws and regulations. However, We shall not be liable for any loss caused by the termination of the Agreement, except for the losses caused by Our intentional or gross negligence.
7 Dispute Resolution
7.1 Any dispute arising from or in connection with this Agreement shall be resolved through friendly negotiation between You and Us first. If the negotiation fails, either party may initiate legal proceedings in the people's court where Our main place of business is located.
7.2 This Agreement shall be governed by the laws of the country/region where Our main place of business is located, excluding the conflict of laws provisions thereof.
8 Miscellaneous
8.1 We have the right to revise this Agreement from time to time. The revised Agreement shall be announced through the App or other reasonable means, and shall take effect on the date of announcement. If You continue to use the App after the revised Agreement takes effect, it shall be deemed that You have agreed to the revised Agreement. If You do not agree to the revised Agreement, please stop using the App.
8.2 If any term of this Agreement is deemed invalid or unenforceable due to violation of relevant laws and regulations, the validity of the other terms shall not be affected.
8.3 This Agreement constitutes the entire agreement between You and Us regarding Your use of the App, and supersedes all prior oral or written agreements, understandings, and commitments between the two parties.
